A city businessman, Farouk Mujumba, has taken legal action against the Kampala Capital City Authority (KCCA) for demolishing 13 of his kiosks situated in the New Taxi Park.
Mujumba alleges that despite initially receiving permission from KCCA to construct the kiosks, they were later unlawfully demolished in January 2022.
According to court documents filed in the Commercial Court, Mujumba applied to KCCA in November 2013 to set up modern kiosks in the New Taxi Park.
He followed the required procedures, including making payments as per KCCA’s assessment, to obtain approval for the construction of the kiosks.
However, in 2022, KCCA, with unauthorized agents and police, demolished Mujumba’s kiosks and those of his tenants, causing losses amounting to over Shs688 million.
Mujumba is seeking compensation of more than Shs200 million for the investment lost and expenses incurred in setting up the approved kiosks, as well as the rental earnings lost due to the demolition.
In its defense, KCCA argued that the land where the kiosks were located fell within a road reserve and had utility lines passing through it, necessitating their removal.
Additionally, KCCA stated that Mujumba’s (the businessman) permission to maintain the kiosks on the land was not renewed for 2021, and a demolition exercise was carried out in January 2022 to clear illegal structures within the road reserve.
The case is pending before the Commercial Court, awaiting further proceedings and a ruling.
